Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of Home Clarity, a service that uses AI to produce plain-English breakdowns of UK home survey reports (RICS Level 2, RICS Level 3, and Scottish Home Reports).

Home Clarity is operated by [YOUR LEGAL NAME OR LIMITED COMPANY] of [YOUR REGISTERED OR TRADING ADDRESS] ("we", "us"). By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.

2. Eligibility

You must be at least 18 years old, capable of forming a binding contract under English law, and resident in the United Kingdom to use the service.

You confirm that any survey PDF you upload is one you have the right to upload and have analysed (your own purchase, or one shared with you in a professional capacity with the owner's consent).

3. Your account

You are responsible for keeping your account credentials confidential and for any activity that takes place under your account. Tell us at support@home-clarity.co.uk if you suspect unauthorised use.

One account per person. Do not share access with others; use referrals if you want to invite someone.

4. The service

You upload a UK home survey PDF. We use third-party AI providers to generate a structured analysis: condition ratings, identified issues, indicative repair cost ranges, negotiation points, and a verdict.

The output is for information only. It is not professional surveying, legal, financial, or mortgage advice. Cost ranges are indicative and based on typical UK market rates; actual costs vary by region, contractor, and scope of works.

You should always consult a qualified RICS-accredited surveyor and your conveyancing solicitor before making property decisions based on a survey.

5. Credits, payment, and refunds

The service is sold in credit packs through Stripe. One report analysis costs 5 credits. Credits do not expire.

Statutory cooling-off right (Consumer Contracts Regulations 2013): you have 14 days from purchase to cancel and receive a refund of unused credits. By using a credit to run a report, you consent to immediate performance of the digital service for that report and waive your cooling-off right for that specific report.

Refunds for unused credits: email support@home-clarity.co.uk within 30 days of purchase and we will refund the unused portion to your original payment method.

Refunds for used credits (i.e. reports already generated) are at our discretion. We will consider them in cases of clear technical failure where the analysis was unusable.

6. AI accuracy and limitations

The analyses are produced by AI models from the contents of your uploaded survey. AI can misread, miss, or misinterpret information. We do not guarantee accuracy, completeness, or fitness for any specific purpose.

The analysis is a starting point for your own thinking and a prompt for the right professional questions. It is not a replacement for the surveyor who wrote the original report or the professionals you instruct on your purchase.

You accept that you must independently verify any material point in the analysis, in particular cost estimates, before acting on it.

7. Acceptable use

You must not: upload surveys you do not have the right to upload, attempt to reverse-engineer or scrape the service, use it to provide regulated surveying or legal advice to third parties without your own professional credentials, attempt to overload or attack our infrastructure, or use the service for any unlawful purpose.

We may suspend or terminate accounts that breach this section without refund for credits already used.

8. Intellectual property

You retain all rights in the survey PDFs you upload. By uploading you grant us a limited licence to process them solely for the purpose of producing your analysis.

The analysis output is licensed to you for personal or internal professional use. You may share the output with your solicitor, surveyor, or other advisors involved in your purchase.

The Home Clarity name, logo, software, and product design remain our property.

9. Limitation of liability

To the fullest extent permitted by English law, our total liability to you for any claim arising out of or in connection with the service is limited to the total amount you have paid us in the 12 months immediately preceding the event giving rise to the claim.

We are not liable for indirect, consequential, or special loss, including (without limitation) loss of profits, loss of opportunity, loss of property value, mortgage offer changes, transaction collapse, or any third-party costs you incur in reliance on the analysis.

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability that cannot be limited or excluded under English law.

10. Termination

You may close your account at any time by emailing support@home-clarity.co.uk. We will refund any unused credits in line with section 5.

We may suspend or close accounts that breach these Terms, that have been inactive for an extended period (with reasonable notice), or where we are required to by law.

11. Changes to the service and these Terms

We may update the service and these Terms over time. Material changes to the Terms will be communicated by email or by a prominent notice on the site at least 14 days before they take effect. Continued use after that constitutes acceptance.

12. Governing law

These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with them is subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer law in your country of residence requires otherwise.
